TERMS OF SERVICE

1. About SolaSpot

SolaSpot operates from Adelaide, South Australia, and supplies products to customers in Australia and the United States.

These Terms govern purchases through our online store and use of our website. “We”, “us” and “our” refer to the business trading as SolaSpot.

Our store is hosted by Shopify. Our Privacy Policy and Returns & Refund Policy provide additional information about how we handle personal information and resolve product concerns.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited.

2. Using Our Website

You must have legal capacity to place an order, or permission from a parent or guardian where appropriate.

You must not use our website to commit fraud, submit unlawful content, infringe another person’s rights, interfere with security, introduce malicious software or collect other customers’ information without permission.

We may restrict website access where reasonably necessary to address these activities. This does not remove our obligations for existing orders or your consumer rights.

3. Product Information

We aim to provide accurate product descriptions, dimensions, materials, images and pricing.

Colours and finishes may appear different depending on your screen, lighting and viewing conditions. Product descriptions and selected options identify what is included in your purchase.

Lifestyle images may show accessories or surroundings that are not included. Design previews illustrate your selections; they are not photographs of the finished product.

These statements do not excuse a material difference between the product supplied and its description or your agreed order.

4. Custom-Made Products

Our plaques are made to your selected design and personalisation details.

Please carefully check your house number, wording, spelling, font, colours, finish and other selections before ordering. If we provide an artwork proof for approval, please check it before approving production.

We manufacture using the details you submit or subsequently approve. If you discover an error, contact us immediately. Changes may not be possible once production begins.

If we manufacture your product incorrectly or it does not match the agreed order, we will address the issue under our Returns & Refund Policy and applicable consumer law.

5. Orders & Availability

Please provide accurate contact, billing and delivery details.

If we cannot fulfil an order because of availability, suspected fraud, a payment problem or another legitimate reason, we will contact you. If we cancel an order, we will refund any payment for products we will not supply.

We will not substitute a materially different product or change your agreed design without your consent.

6. Prices, Currency & Payment

The applicable currency is displayed on the storefront and at checkout. Please check the currency and final order total before paying.

Applicable taxes, shipping charges and any duties or import charges collected through checkout will be shown before you complete your purchase.

Any additional import charges not collected at checkout will be handled according to the disclosures provided for your order and applicable law.

Payment methods are those displayed at checkout. Any payment-plan agreement is subject to the provider’s terms and eligibility requirements.

Prices and offers may change for future purchases. We will not increase the price of an existing order without your agreement.

If a material pricing or listing error affects your order, we will contact you to explain it and agree on a resolution. If you do not accept a proposed correction and we cannot fulfil the order as placed, we will cancel it and refund the payment, subject to applicable law.

7. Discounts & Promotions

Discount codes and promotions are subject to the conditions communicated with the offer, including any expiry date, product exclusions or minimum spend.

Offers may not combine unless expressly stated. Please confirm that your discount appears before completing payment.

If you forget a code, contact us promptly. We will check its eligibility and whether an adjustment is possible.

Changes to promotions do not remove benefits already agreed for an existing order.

8. Production & Dispatch

Each plaque is custom-made in our Adelaide workshop. Please allow 2–3 weeks from placing your order to dispatch, whether you’re ordering from Australia or the United States.

Orders placed Sunday through Saturday normally enter the production batch starting the following Monday. Your plaque is manufactured during that Monday-to-Friday week, then packaged and dispatched the following week.

We aim to dispatch sooner wherever possible, but please plan around the full three-week timeframe. Our production schedule follows Australian local time.

If missing information, artwork approval or requested changes affect your production schedule, we will contact you to explain any revised timeframe.

Delivery time is additional and varies by destination. If we expect to dispatch later than the stated timeframe, we will contact you with an updated estimate and your options, as outlined in Section 9.

Tracking numbers may be generated before dispatch because we prepare shipping labels in batches. A tracking notification does not, by itself, confirm that your parcel has left our workshop.

9. Delivery & Delays

Delivery estimates are provided on our shipping pages or at checkout. Delivery time is additional to production time.

For US orders, our current estimated delivery timeframe is 10–15 business days after dispatch. Australian delivery estimates are provided separately.

Carrier delays, customs processing, public holidays and remote destinations may affect delivery. Estimates do not remove your rights if we fail to supply your order as required by law.

If we cannot dispatch within the timeframe represented for your order, we will contact you with a revised estimate and explain your options.

For US orders, where applicable law requires it, we will seek your consent to a shipping delay or provide a prompt refund for unshipped products. Any legal cancellation right takes precedence over our custom-made cancellation restrictions.

If an order is lost, substantially delayed or marked delivered but not received, contact us so we can investigate with the carrier and arrange an appropriate resolution.

10. Order Changes & Cancellations

Email support@solaspot.com.au as soon as possible if you need to change or cancel an order.

We will check whether production has begun and whether we can accommodate your request. Once manufacturing starts, change-of-mind changes or cancellations may not be possible.

If a requested change involves additional work or cost, we will explain it and obtain your agreement before proceeding.

These restrictions do not affect cancellation or refund rights available under applicable law, including rights relating to shipping delays or product problems.

11. Returns, Refunds & Guarantees

Custom-made plaques are not eligible for change-of-mind returns or exchanges.

Our 30-Day Satisfaction Guarantee covers concerns about the quality and finish of your plaque, as described in our Returns & Refund Policy. Contact us within 30 days of delivery to request assistance under that guarantee.

Any Lifetime Replacement Guarantee advertised for your product applies according to its published terms.

Our voluntary guarantees are additional to your consumer rights. They do not impose a 30-day limit on faulty-product claims or replace any legal entitlement to a repair, replacement, refund or compensation.

Please refer to our Returns & Refund Policy for return instructions and refund information.

12. Installation & Solar Performance

Please follow the installation and operating instructions supplied with your product. Check that your chosen mounting surface and fixings are suitable.

Solar products require suitable sunlight exposure. Charging and illumination duration vary with placement, shading, weather, season, operating mode and battery condition.

Unless expressly stated in the product description, we do not promise a fixed illumination duration in every environment.

If you believe your product is faulty or does not perform as described, contact us for assistance. These practical requirements do not remove your consumer rights.

13. Designs & Intellectual Property

SolaSpot’s website content, product photography, branding and original designs are owned by us or used with permission. You may not reproduce or commercially exploit them without permission or another lawful basis.

You retain any rights you hold in artwork or content you submit. By submitting it for an order, you give us permission to use it as reasonably necessary to design, manufacture and fulfil that order.

You must have permission to use any third-party images, logos or artwork you ask us to reproduce.

Submitting content for an order does not automatically give us permission to use it in advertising.

14. Reviews & Customer Content

Reviews must reflect genuine experiences and must not contain unlawful material, private information about others or content that infringes another person’s rights.

A review submitted for publication may be displayed with the information you choose to include.

We will seek permission before using privately supplied customer photos for promotional purposes, consistent with our Privacy Policy.

15. Third-Party Services & Links

Our store uses third-party services for functions such as payments, product personalisation and delivery. Separate provider terms may apply to services you choose to use.

Links to external websites are provided for convenience. Please review their terms and privacy practices.

The involvement of a third party does not remove SolaSpot’s responsibilities for products we sell or obligations we owe under applicable law.

16. Privacy

Our Privacy Policy explains how we collect, use, store and share personal information, including information used to personalise products and fulfil international orders.

Privacy enquiries may be sent to support@solaspot.com.au.

17. Consumer Rights & Responsibility

We remain responsible for obligations imposed by applicable law and promises made about our products.

Nothing in these Terms excludes liability for fraud, negligence or any liability that cannot lawfully be excluded. We do not impose a blanket exclusion of responsibility for faulty products, personal injury or losses for which the law requires us to be responsible.

For Australian customers, Australian Consumer Law guarantees apply where relevant. US customers retain mandatory rights under applicable federal and state law.

18. Resolving Concerns

If you have a concern about an order or these Terms, email support@solaspot.com.au with your order number and relevant details.

We will review the matter and work with you towards a resolution. Contacting us does not prevent you from exercising rights through a regulator, court, payment provider or other available process.

19. Governing Law

These Terms are governed by the laws of South Australia and applicable Australian federal law, subject to mandatory consumer protections that apply to your purchase.

This provision does not deprive customers outside Australia of mandatory protections or rights to bring proceedings in a forum available under applicable law.

20. Changes to These Terms

We may update these Terms for future orders and website use. The latest version will be published on this page with an updated date.

The terms in effect when you place your order apply to that order, unless a change is required by law or agreed with you.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
